If you or your loved one fears persecution in your home country, the United States may offer protection through asylum or refugee status. At The Emory Law Firm, our experienced immigration attorneys in Charlotte and Kinston, North Carolina provide skilled legal representation to individuals seeking safety, freedom, and a new beginning.

What Is Asylum?
Asylum is a form of legal protection granted to individuals who are already in the United States or at a U.S. port of entry and who fear returning to their home country due to persecution. If granted asylum, you can remain in the U.S., work legally, and eventually apply for lawful permanent residency (a green card).
You May Qualify for Asylum If:
- You are physically present in the U.S. or seeking entry at the border
- You have suffered persecution or fear future persecution in your home country
- The persecution is based on at least one of the following grounds:
- Race
- Religion
- Nationality
- Membership in a particular social group
- Political opinion
- You file your asylum application within one year of your arrival (with limited exceptions)
What Is Refugee Status?
Refugee status is similar to asylum but is granted to individuals who are still outside the United States when they apply. Refugees typically go through an interview and vetting process abroad before being approved for resettlement in the U.S.
Once admitted, refugees have the right to live and work in the U.S., and after one year, they may apply for a green card.
Affirmative vs. Defensive Asylum
There are two ways to seek asylum in the U.S.:
- Affirmative Asylum: You file Form I-589 with USCIS while not in removal proceedings. If denied, your case may be referred to immigration court.
- Defensive Asylum: You request asylum as a defense against deportation in immigration court after being placed in removal proceedings.
Whether you are pursuing affirmative or defensive asylum, you need a trusted legal advocate who understands the system and can build a strong case on your behalf.
