PRACTICE OVERVIEW
Protecting Dreamers’ Futures with Trusted DACA Legal Support in Charlotte & Kinston, NC
If you were brought to the United States as a child and are living without legal status, you may be eligible for protection under the Deferred Action for Childhood Arrivals (DACA) program. At The Emory Law Firm, our experienced immigration attorneys in Charlotte and Kinston, North Carolina, help Dreamers navigate the legal system and protect their right to live, work, and build a future in the U.S.

What Is DACA?
Established in 2012, DACA provides temporary relief from deportation and work authorization to eligible undocumented individuals who entered the U.S. as children. While DACA does not provide lawful permanent residency or a path to citizenship, it is a vital protection that allows recipients—known as Dreamers—to contribute to their communities, continue their education, and build stable lives.
Who Qualifies for DACA?
To qualify for DACA, you must meet the following requirements:
- Were under the age of 31 as of June 15, 2012
- Came to the United States before your 16th birthday
- Have continuously resided in the U.S. since June 15, 2007
- Were physically present in the U.S. on June 15, 2012, and at the time of your application
- Had no lawful status on June 15, 2012
- Are currently in school, have graduated or obtained a GED, or are an honorably discharged veteran
- Have not been convicted of a felony, significant misdemeanor, or three or more other misdemeanors
What Does DACA Provide?
Approved DACA recipients receive:
- Protection from deportation (renewable every two years)
- Work authorization with a valid Employment Authorization Document (EAD)
- Eligibility for a Social Security number and, in some states, a driver’s license
- Potential access to state-based tuition programs and benefits
Note: As of now, USCIS is only accepting DACA renewals, not new applications, due to ongoing litigation. Our legal team stays current on policy changes to ensure you have the most accurate and up-to-date guidance.
